Alternative Dispute Resolution (ADR) methods, such as mediation, arbitration and collaborative law, avoid some of the frustration and time-consuming processes of settling marital issues in court. We get to the bottom of spousal issues by using various out of court approaches to resolving divorce and separation issues.

Our process involves using collaborative law, mediation, arbitration and other forms of ADR for family law issues, in which divorcing spouses settle their differences out of court by reaching a compromise mutually acceptable to all parties. Parties to divorce, their attorneys, and any other professionals involved agree to make a good faith attempt to reach an amicable settlement without going to court. We offer several alternate methods to litigation to resolve divorce and separation, custody and child support issues. Our approaches include:

  • Mediation – the parties consent to participate in good faith to work with our mediation attorneys in Beaufort, Myrtle Beach and Columbia, SC toward a mutually agreeable resolution that may result in a legally binding settlement agreement
  • Arbitration – a neutral party known as the arbitrator hears from both sides and, after considering all relevant information, renders a final decision in favor of one of the parties that is usually non-binding, unless the parties agree otherwise. Our Beaufort, Myrtle Beach and Columbia arbitration lawyers can help you through this process.
  • Binding arbitration – this is similar to ‘Arbitration’ (defined above), except under this form of arbitration the decision by the neutral arbitrator is legally binding
  • Collaborative law – the parties voluntarily enter into a participation agreement that binds each other to the process and is intended to minimize differences while working toward the proper resolution. We help ensure the parties abide by the agreement and obey South Carolina law.
  • Other Alternative Dispute Resolution methods – other methods of ADR include the use of negotiations between the two sides and other approaches geared toward settling marital differences outside of court
